Hi,
My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

My employer is going put one newspapaer ad for two employee's. He is doing this to save moeny. Is this ok to put one ad for two employee's? Will there be any probelm in PERM.

Good question. I'm not sure if the two-year home residency requirement applies to tourist visas.
But if your J-1 program isn't subject to the two year residency requirement, I don't see why there would be a problem.

Is it from receipt date based on receipt notice OR filing date( actual date when USCIS received your 485 package)?
Its the USCIS receipt date . July 2 flyers started already countung days to use AC 21\\\\\\Also close the thread as some one already discusiing the same issue

These numbers include Family Based and as per my understanding 90 % of the applications are FB based.
For us who are EB based, the EB backlog should be more realistic and I am not sure how do we get them!

Hi I'm a US citizen and have around 15k or less credit card debt. All government loans were paid off. Something happened three and a half years ago in my home town and I had to leave Washington state and took care of it. So my question is: it's has been 3 and a half year and I'm heading back to washington state for short visit.
1. I'm sure the debt did gall into collection agency. Will it go to court?
2. Since I had been gone since 2007 and will there be a warrant on me since I didn't appear to court (if there was one)
3. I will be entering Vancouver bc airport then to Seattle by driving. I'm afraid I will get caught for warrant at the border.
Hopefully someone can answer my questions and thanks for the help in advance.

Article says "On June 12, 2008, U.S. Citizenship and Immigration Services (USCIS) informed the American Immigration Lawyers Association that the H-1B random selection process has been completed. USCIS completed the intake and receipt processes for all filings as of May 24, 2008 and began mailing rejection notices the week of June 9. Therefore, if an employer has not yet received a filing confirmation (Form I-797C Notice of Action), it likely means that the petition was not selected in the random process and that the rejection notice will be forthcoming."

My PD is 08 july 2004. ND 08/09/2009 (NSC) and no approval yet. Multiple SLUD's from 4/2/09 - 04/16/09 on dependents and my cases after we sent response to RFE.
Last update was on 04/16/09.
Opened an SR on 09/03/09 and the wait goes on ...
Its furstrating to see the "Inorderly" and "out of turn" approvals ...
I don't want the miss the boat as PD later than me are using up the numbers.
There must be lots of IV members who are in similar situation.
Attorneys please suggest how we should tackle this.

Fedex does not renew the H1B visa even if their present employees are in H1B visa. this is the policy they are following nowadays.
