One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.
Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.

My Receipt date for 485 is july 27th 2007 and nebraska is processing applications for this date.
I applied for cross chargeability on 10th March.. Any idea how long before my case is approved? My lawyer has confirmed that its possible and he claims that it should take 4-8 weeks. I wanted to check to see what the experience of people has been so far?

Hello Gurus,
I have filed my PERM through my employer and they mis-spelled my name wrongly. How can I correct this. Still my labor is in pending condition. My employer says we will change it once got approved. But is there a way to correct it before it gets approved?. Please advice me.

I want to change my employer from A to B. B has filled for h1b transfer on 26-sept-2007 (I have fedex tracking number). Till today (9-oct-2007) we hv not received the receipt notice.
My expected start date was 1-oct which has been extended twice, i.e 8th & then 15th. If receipt does not come will 15th, then can I join the new employer?
Is there any way I can find out the file position/status using fedex tracking number?
Can new employer file one more application for h1 transfer under premium process?

Guys, we should have more rallies like the SJ one in bay area.. the next target can be San Francisco - Civic Center.
There are many official bulidings like City Hall here and we will definitely get heard again.
I always suggested for this type of gathering on roads so as to get heard. THIS WAS A JOB WELL DONE by people who attended and organized.
Finally to gsc and others, save banners and material from the the SJ rally so that we dont have to start from scrach.
For the people who didnt make it, please attend the next one no matter what.
What do u guys say for Aug 18 ?

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

We should think of starting this thread to organize bus rides from Texas. If we use U.S. Coachways, which is in most major cities, we could potentially have buses leave from the major metros (Houston, Dallas, San Antonio and Austin) or two or more buses leaving Houston and San Antonio in the south and picking up more people as they make their way north to Dallas and Austin. Beyond Texas, the buses could also pick people up in Louisiana, Mississippi, Alabama, Georgia, etc, or other states depending on the routes. Also, a great and reliable local Dallas bus company is "Buses by Bill"

Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?

I am doing my second masters from a university with a valid i20. I have a CPT till the end of Aug 2008. I have a approval notice for H1B with start date of OCT 1 2008.
I am planning to discontinue the course from Fall (Starts sep 1st) 2008. Because there is only one month gap between Fall Semester and H1b start, is it possible i stay in the US without taking any courses at the university. i do not mind not working if i have an option to stay back in US till oct 1st.
i am trying to avoid a hefty fee for the whole semester, i need to fill the gap from SEP 1st 2008 to OCT 1st 2008

If you have EAD, H1 & H4 can work in your own business and work in current H1.
H1 & H4 (without EAD) forget about starting business and sit in your own company/shop/gas station etc.... & MAKE MONEY. This is the fact.
