If you are beyond 6 years and I-485 denied then applicant is doomed weather you are in H1 or EAD. Only route is MTR. My attorney confirmed it.
She suggest unless MTR get open. You should not even work to avoid the issues.
So it does depend attorney to attorney. I don't think we have any case examples in either senarios. So bottom-line, do whatever you feel correct and make you happy. :)
Personally, I think RG is seems more logical. If you use EAD your H1 becomes invalid. No one revokes but it happens. Similarly, H1 becomes invalid as underline petition get denied.

I think this question may have been addressed before, so I apologize for the duplication.
I am trying to change my job and have an approved I-140 with a priority date of August 2006. The question is if I am successful in porting my old August PD for my new I-140 applied after May 2007, would I come under this new merit system? Any help would be greatly appreciated.

I understand your pain ( I am in the same boat ). EB3-I PD:June 2003. All we can do is keep the struggle going.
Why should you contribute, because if it wasnt for IV following up with Congresswoman Lofgren, your signature would simply read:

He got info from USCIS through congressional liason that his 140 was indeed approved on the date when the IO claimed it was denied and it was indeed revoked when he got a denial. The revoke was initiated by his employer.
They seem to have all info proper. There is no faulty system. If there is faulty system, probably we have known by now with things never happening right

My take is that the system used by USCIS is not designed to check for AC21 cases and so rightfully, when IO sees denied I-140, they deny the I-485. I think their Manual is also not updated to reflect AC21. AC21 is still a memo and not in their Manual.

Considering 7% country quota and 26.7% EB2 quota of 140k, we get 2800 visa for EB2 annually. For first month this number comes out to be 234. Considering 1.2 dependents this means 106 families get GC under EB2.
I am sure they have more than 106 cases before the cutoff of 1 April 2003. This may also include people delayed by background checks.
But at the same time EB2 will get spillover from EB1 and EB2 ROW, so its expected that EB2 I will move forward. But how much that spillover is gonna be? Any data?

you might want to contact the indian community that donated to Hillary and inform them with her vote against immigrants. they need to write her a letter asking for answers. she has to know that legal immigrants have supports from their communities like this community that donated money ($2M is a lot of money and should have a word for it)

I came to USA in July 1997. I did my masters here. I worked for 3 fortune 500 companies so far. I have been with one company since last 11 years. I am on EB3(mar 2003). I am a senior manager in fortune 50 company and on the path towards directorship. I wish I had green card, that didn't prevent me from having a good life and career. I brought an house 10 years ago. All I can see few more years of wait. Reg' Pappu post about action, the only action I can take is converting my case to EB2, which I tried several times within the company and it didn't work. The second action I can take is change employer. I have a good career, pay in this job, not sure if I would be able to get same one outside.

I have talked to a representative and he very patiently explained me about the mess.
He clearly and very clearly told me that they have a deadline to send all receipts for June end and July 2nd filers by friday (tomorrow) or worst case monday.
He mentioned that they are working hard to meet this deadline.
Hope this clears the anxiety.

sounakc, sw33t - it seems you need more info to decide. Please post here about the info you need. We have many people who are pretty knowledgeable on matters related to AC21 (like chaduv) who might be able to answer them. If it is something about this campaign and have questions - please shoot, will try to explain why we are considering it is a serious one and can affect anyone.
Everything related to EB immigration is grim for last couple years - the only two things that made some positive impact on us are July 07 fiasco and admin reforms. IV made great efforts to achieve them against all odds (just like RedSox win yesterday :)) - those two combined with AC21 regulations provided many of us the flexibility and career advancement that we missed because of this cesspool called GC. Now that flexibility is at stake. What is the use of AC21 regulations and EAD if we are not certain about whether our I485 will not be denied later.
Some have pointed out that this will not affect them or that their previous employer will not revoke I140. First of all - never assume your I140 will not be revoked - it can happen in many circumstances even if you had good relations with employer. And even if you are not planning to use AC21 right now, think about this: we are all in this together to make EB immigration better. When things are tough to make any change (legislatively or administratively) - we cannot afford to lose one of the very few positive things that happened to us. IV core fought for us - spending their time and even money - lets take some inspiration from their acts, and show them that we volunteers are serious when we say that we want to contribute to IV and make a difference to EB laws or USCIS functioning.

Everything related to EB immigration is grim for last couple years - the only two things that made some positive impact on us are July 07 fiasco and admin reforms. IV made great efforts to achieve them against all odds (just like RedSox win yesterday :)) - those two combined with AC21 regulations provided many of us the flexibility and career advancement that we missed because of this cesspool called GC. Now that flexibility is at stake. What is the use of AC21 regulations and EAD if we are not certain about whether our I485 will not be denied later.
Some have pointed out that this will not affect them or that their previous employer will not revoke I140. First of all - never assume your I140 will not be revoked - it can happen in many circumstances even if you had good relations with employer. And even if you are not planning to use AC21 right now, think about this: we are all in this together to make EB immigration better. When things are tough to make any change (legislatively or administratively) - we cannot afford to lose one of the very few positive things that happened to us. IV core fought for us - spending their time and even money - lets take some inspiration from their acts, and show them that we volunteers are serious when we say that we want to contribute to IV and make a difference to EB laws or USCIS functioning.
