Is it legal to pass the fee hike to the employee? or is it like the Fraud Prevention fee which is illegal to be passed on to the employee..?
this will change the equation until companies assimilate this in and find the work around! well, it definitely eats into their 'profit' i guess!

Well, if you do the direct calculations (eventhough it looks correct for most of us), it always results scary.

But that does not happen always. A Government Agency decided to accept that many applications in a month window, defintely it would not have been decided in a lunch or dinner meeting.

They should have known their limitations and how to handle the situation. If there are 20K 485 applications sitting at the storage, it would not create much problems. But it creates so much administration issues if the number is 600K applications.

One major issue is, every year they are going to receive 600K EAD renewals. They will never get time to work on 485, but life long working on renewing this EAD's and no more further GC processing.

So, its not going to be the case. Now they have money, even if it takes first year some more months, they may go for hiring more contracters OR spliting the applications across different centers processing them.

Its a big administration issue to the agency to keep all the applications pending than us.

So, no worries. There must be a solution ahead for us.

My adjustment application is pending for almost five years now. I was not in the habit of tracking LUDs but of late I was tracking and concluded that most of the time it means nothing.
Here is what happened today. My attorney had applied for my travel document on Jan 28. I got three soft LUDs between Feb 8 to 10. Status remaing same "Case received and pending". To my surprise today I received my travel documents from my attorney. The issue date on the document is March 5. My attorney mailed it to me on March 3, I believe as soon as he received it.
The last LUD on my case is still Feb 10 and the status still says "Received and Pending".
I think we should not go too much by the LUDs.

Which part says that you are not eligible? Please elaborate.

    both husband-wife should have SSN.

what about july filers. Most have received SSN for H4 by now.

those who already filed using ITIN might be at loss.

Did any of you get the same letter with the same content below .........what baffles me is the last sentence that says "The application will be reopened and the processing continued. Once the processing is completed, you will receive a notice under separate cover."

Your help is really appreciated in this.........Sorry I am little bit pessimistic here......

    FINAL UPDATE

    HURRAHHHHHHHHHHHHHHHHHHHHYYYYYYYYYYYYYY

My I-485 case got reopened after being in denial status for three months............ My attorney got a letter from USCIS.

    ::::::::::::::::::To recap::::::::::::::

I went to the Congressional office on 05/14/2009 morning.
Congressional office made a call to Nebraska Service Center regarding the case on the same day afternoon (05/14/2009 afternoon)
USCIS sent letter to my attorney on Friday (05/15/2009).
My attorney received it this morning (05/19/2009).

Looks like magic........Whoever has been working on my case from the past three months made a huge reversal decision in just a few hours on 05/14/2009 afternoon with atmost attention........I like this sudden surge in commitment and care on my case.......

    Here is the wording:

    Quote""""""""""""""""""""""""

Reference is made to the Notice of Appeal or Motion (Form I-290B) filed on April 23, 2009. You are seeking reopen the decision rendered by USCIS on February 17, 2009, denying application filed by you.

The motion as submitted has been reviewed. It meets the requirements of Title 8, COde of Federal Regulations, $103.5 concerning the proper filing of a motion. Accordingly, the request to reopen the previous decision will be and is hereby granted.

The facts and issues in this matter were properly discussed in the decision, supra, and need not be repeated here as they are a matter of record.

After a complete review of the record of proceedings, including your motion, the grounds for denial have been overcome.

The application will be reopened and the processing continued. Once the processing is completed, you will receive a notice under separate cover.

    Sincerely

    """""""""""""""""""""""""""""""""""""Unquote

All this May 15th/21 date is open to interepretation there is no set concrete laws yet.I just filed I-140 and I-1485 on the 1 st June and my attorney told me just go and wait now and live your life.We can worry about stupid laws that MIGHT go into affect a yr or never and destroy your precious time.
In the meantime go to NUMBERSUSA website and send as many faxs against this CIR bill and get it shutdown.

Yes i know NUMBERSUSA is anti-immigrant but in this situation it beneficial to all us legals if this bill goes down in flames.
How could you file the 140 and 485 at the same time, are you filing in EB1 catagory? which country?

It's stupid to have rules around which expect Immigrants from India and China to hold on to their jobs for 10 years without changing it when everyone around is losing their jobs.

Pappu, then why no to plan for another letter campaign, if that is what making things work a little bit.

It will work only if we can have 10s of thousands of letters.
If admin fixes had so many letters we would have been in a better spot today. With only 5 thousand or something letters and many of them anonymous, we cannot have our hopes very high.

Unless people suffering take the initiative, our initiatives will have a hard time getting results. IV is every member here (and not just core members or chapter leaders) and if members feel the heat of retrogression, they need to take the initiative and get active.

Hope this bulletin will help people focus on action items.

I agree with the above posts, they are stealing money by having stupid charges. Why do you need to charge a customer Rs.400 for changing his account password. It is absolutely ridiculous! Compare that to a bank in US, you just go online and change the password. Also, they have 2 passwords one called Account password to login to the account and another called Transaction password for making any transactions. So the more number of passwords you have the more you tend to forget either of them and they can charge you Rs.400 for each password reset!

I had the same experience with ICICI for password change. They wanted 1% fees for Loan sanction

Mandamus is a case where plaintiff is trying to force a government official to perform his/her duty. It's being used when a case is delayed beyond reasonable time frame. See more details here:

Wrongful denial is disputed based on the Administrative Procedures Act (the APA)
The APA allows reversal of agency action that is arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law. 5 U.S.C. 706(2)(A).
Generally, you cannod dispute I-485 denial unless denial was based on wrong intepretation of applicant's eligibility for AOS. See, e.g. Sepulveda v. Gonzales, 407 F.3d 59, 62-63 (2d Cir. 2005)

Immigration litigation attorney should be able to help, but it's fairly simple to do on your own as well.

this is extremely useful information. Can you please update IV Wiki, when you get a chance ? www.immigrationvoice.com/wiki

    My PD EB3 01/15/2005
    Applied I140 PP 05/18/2007
    Approved I140 05/23/2007

    Man I am screwed

I received good news on June 1, 2007 that my I-140 is approved. It was received by USCIS on May 22, 2007. Then later that day I saw the new immigration bill. If this very unreasonable bill (EB backlog) will be passed the wasting of all the money, time, stress, anxiety and hope towards the GC procedure will make the whole thing look like a bitter joke. This is beyong my wildest imagination on how bad things can go since we are all hard-working and law-abiding legal immigrants. Is it a punishment for being a good member of society?

I'm praying that it will not be given any consideration by those who have powers.

I hope you would stop reading between the lines some day:-)

Why don't you listen to others on this forum? No one is out to screw H-1s and/or GC aspirants as far as the rebate is concerned. Read the previous post by gg10004. The law is not differentiating between a H1 and GC aspirant or a US citizen if none of them have a valid SSN. It is just unfortunate that H4s do not get SSNs. So stop getting paranoid.

Moreover, your response that your title "No Stimulus Package to H1's and GC Aspirants - Again We Loose 1200$" is justified because titles are not for stories or whatever makes you look like an utter idiot. Titles are for accurately reflecting the gist of the thread. If you have an issue with adding 5 more words to reflect the reality, then add only one word: "No Stimulus Package to SOME H1's and GC Aspirants - Again We Loose 1200$".

Good they have seem to have read recently published IV analysis and recommendations and provided a much more detailed bulletin this month for the community.

agreed. kudos to IV core to push for more detailed explanations without which proposals for fixing this backlog also becomes difficult.

Or do you need us to write to each of them?
I will send to washington post, new york times, AP and Reuters. I have posted the reporters that I will correspond with.

These lists are not complete. I am updating the lists.
