Hello
I am working on H1 and my current H1 petition is valid until April 6th 2011.
My visa (stamp) expired in Nov 2009.
I have my new H1 extension petition approved from April 7th 2011- 2014( same employer).
I am going to India early Feb and will going to Hyd/Chennai for visa stamp.
In the visa appointment it is asking for my petition number: which one should I give current or the new extension one. I would like to have my H1 stamped until 2014 so that I can avoid additional trip to consulate.
Please help.

Your H1b will be cancelled without prejudice. You can have only 1 typeof visa stamped on your passport

Ajay K Arora from H1B1.com was a good lawyer for me. I was in KY at the time and had the luxury of choosing my own immigration lawyer. I did H1 + renewal, and RIR labor that got recently approved, but I am with a different company now, so can't use labor cert, and I have to put up with the company's law firm whose service is of course, awful.
He is located in NYC. The reason I chose him is someone else recommended him for me.

Hi
I need to travel out of US urgently because of family emergency.
1) Can I get emergency AP from local/district ofices with supporting documents
2) I saw that I can travel until I get my AP approved.Has any oine denied entry because of they travelled out of US while ap processing is pending.Any experiences..

We also need to raise our voice for the Out of Status stuff.
Most of the consultants have one or more pay stub missing etc. There needs to be a amendment that more than 6 months so called out of status can also adjust their status by paying some fine or something because
1. Most of the employee are ignorant about this
2. and most employers take advantage of the situation and they are the ones who should be accountable and not the employees.

H-1B visas are a relatively swift path to employment for foreigners with bachelor's degrees and U.S. employers to sponsor them. Each year, the U.S. government makes 65,000 H-1B visas available to qualified individuals on a first-come basis. The cap has been reached every year for the last several years, and for fiscal year 2008, it was reached on the first day of filing. As of July 10, 2009, U.S. Citizenship and Immigration Services (USCIS) had received 44,900 H-1B cap-subject petitions that have been counted towards the 65,000 H-1B cap. My cousin who came here on H4, found a company that sponsored her H1-b and she was working as a consultant to a big firm. She had to return to home country last year, and she had to get her papers stamped - which was denied.
she continues to work for the same firm from India. She has a house in the US, that she has put on market, and continues to pay the mortgage. Does she realistically have a chance of returning to the US on H1-B?

I am working on EAD for a company A (I have approved H1 with company B). i want to maintain both the statuses, can i do that by running the paycheck with H1 company?
You cannot be on H1-B if you are working using EAD.
2)
my fiancee is on H1 status and i want to change her status from H1 to H4 (H1 getting expired). will it be ok as long as i maiting H1 status?

In order to qualify for H-4, the person has to be a legal dependent on the person holding H1-B. AFAIK, fiancee is not legally a dependent.

Guys,
I submitted 485 application for me (primary) and my wife (secondary); now she is changing her job before we can get the receipt for 485 filing....she is on h1B....the new employer will file her H1B transfer..........does anyone see any issue with this????
I think its fine as her H1 status is independent of we filing 485....any thoughts?

Hello
I came to the U.S when i was 12 from germany on a vwp and have stayed here ever since i'm 21 years old now married to a U.S citizen, I have all the papers filled out ready to send to the USCIS for AOS thru marriage to a us citizen but our attorney has warned us that there has been recent denials in these types of cases Im very terrified and clueless i dont know if i should proceed and go for it or just wait and see if anything changes.
Please let me know if you or someone you know has gone thru this.

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

I am wondering what kind of resistance, if at all, is the IV seeing in democratic controlled senate and congress seeing since these bills can be viewed as big business-supported or republican supported.
It would be good to get more democrats to sponsor these bills rathar just have them give lip service to our cause since they have the majority.

Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

Hi all,
I received an I-485 RFE for me and my spouse on July 28th. For the primary applicant it was Employment verification letter (currently dated letter from employer describing duties,position and salary info) and for my wife it was about proof of bonafide marriage.
My attorney replied to RFE on Aug 6th with necessary evidence and EVL.
Online status for both of us changed today Aug 10th from RFE SENT to RESPONSE TO RFE RECEIVED AND CASE PROCESSING RESUMED.
Hope this info is helpful in estimating time for people in similar situations.
PD DEC 04 EB3 I . Whats next ??
