Hi All,
My parents I94 is expiring on March 27th 2008.
We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?
Means, they reviewd all cases wherever the VISA dates were allocated/available. As you are from India, you have thousands of cases ahead of you.

have AP will travel ...
For adjustee's AP gives permission to travel out-in. I think it should be ok to travel (you can subscribe to case updates and you'll know the case status)

Perhaps there is a chance we'll see some action on the DREAM Act in 2011 albeit with some major tough to accept changes. The key areas likely to change are the education requirement (mandating actually receiving a degree versus simply attending school), the ability to sponsor relatives down the road when DREAM Act finally become citizens (at least 13 years out) and criminal bars on applying.

I do not think, we need to break our head against House repulican, they are so bias in their thinking and approch.
I think, senate version will have some chance of incorporating SKILL bill, since they are usually broad minded and willing to listern.

I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

Can one obtain a photo ID on a visitor visa? This way the visitor need not go everywhere with his / her passport. Please advise.
If you can manage to get the points required to get a State Photo ID then you can get it. It will be valid for the period of the visitor visa.
