Hello,
Currently my 485 is pending over 1.5 years with I-140 approval (2007). I was laid-off. I have valid EAD card. Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.
Any input is appreciated. Thanks in advance guys.

My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.
The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

Yes, You can file for H1 extension and they will give you extension for the remaining period of 6 years.
FYI, total days of 6 years are counted based on your presence in US. so, even your out of US periods also can be recaptured.

Hi all,
I am on h1b right now but had applied only for AP since i do not have valid stamping on my passport but have an approved renewed h1b extension valid till 2012.
My AP will be expiring coming nov 2009 and have the following questions,
1) How many days before expiry can i apply for the AP renewal. If i apply now the texas processing times for AP is around Apr 1 2009, does it mean the new AP they will provide from Aug 2009 to Aug 2010 or from my AP expiry date which is nov 2009 to nov 2010?
2) I am also thinking of applying for EAD to keep as a backup (just in case).
Can i apply EAD alone now and wait for nov to apply for AP (or should i apply both together) ?
3) If i do a paper based filing does it mean there will be no request for finger printing?

I need your help to come to a conclusion on my issue.
1) I am on L1-b now in USA and working on company A
2) company B filed me and H1B as consulate process(means i have to get
stamped to start working for them)
Recently company B filed me labor+ I-140 mentioning as future employment and they are planning to file I 485 also now(since we have current dates)
Now I am planning to quit company A for who i am working on L1 and want to go for stamping to join company B who will be filing 485 for me. I have plans to travel to canada for stamping on August last week (after 485 filing).
Do we have any issues to get the stamping for new company who filed my 485
any help is greatly appriciated.

Hello gurus..
I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?
All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

I received RFE letter from USCIS for missing TB skin test result in the medical reports.I took TB skin test in 2007 and came out negative.Here is the test of RFE
"your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
After consulting the doctor concerned, she filled up new I-693 form with 2007 test results and provide me I-69e form in a sealed envelop. Can you please let me know whether 2007 TB skin test results will be acceptible to USCIS or do I need to do another TB skin test? Please Help.

My Eb3 application is July 2002.
It was untouched until this month, where it is undergoing 'initial review'.
Considering they haven't looked at it in 8 years .. I'm happy :).
Any ideas on whether the Oct bulletin will see this move from Jan 2002 to a say Dec 2002?

I had a 221g in 2000 and submitted all the docs. I got response in 2002 (After 2 years :eek:) . I had just 10 months left on my H1 that time. So we will never know. But situation in 2000 was different. I am not discouraging you but telling how hard these 221gs will be. I hope its not that bad these days and you may get response soon.

My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.
But, as per instructions for I-765 and I-131, form should be filed at:
"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."
Can someone guide me please ? Where should I file - TSC of NSC ?
