I listened intently to President Obama's State of the Union speech yesterday. The man is clearly a gifted orator. He stressed the need for cooperation between Democrats and Republicans on the big issues facing our country: the economy, climate change and health care reform, but where oh where was immigration? Finally, after the President was over one hour into his speech, I heard the word "immigration". One sentence. If i get you right, what you are asking is H1 to F1 conversion, why it is not possible ?
It is possible provided if one is maintaining his or her H1 status, till requesting to convert to F1.

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?

generally its filled 4 weeks ahead, so keep trying. first get a canadian visa from nearby canada embassy or by courier/mail

Earlier today, I mentioned this provision which would bar DHS from using funds to delay or rescind the no-match rule. The amendment passed by a voice vote, but in consulting with a knowledgeable source, it seems likely that the amendment will not have much affect. That's because it bars DHS from using funds from its 2010 budget for this purpose. As long as DHS rescinds the rule before September 30th (which now seems likely given yesterday's DHS announcement), no 2010 funds would be needed to achieve this result. I had filled my & my wife's 485 on July 16th 2007. However I noticed that the check that I had sent for my 485 had a minor overwriting in the amount field. I had filed for my wife's H-4 extension last month with a similar issue in the check and the USCIS has sent the H-4 application back. Obviously, I do not want the 485 application to be rejected. So i need urgent help on this matter from you all immigration experts, please help me weigh my options:
1.) Can I refile 485 for me and my wife? Is it possible to have 2 485 applications for a person.
2.) If I refile, and then the USCIS accepts my first application, then will loose the fees for second application or will it be refunded?
3.) Do you think I will simply be asked for another check if I dont refile (which I really doubt.)
I know the mistake might sound stupid but Please guide me in this dilemma. Any help will be greatly appreciated.

Yes, it can be transferred. Fees will include a fee for I-129 ($320) and a fraud prevention fee, which is $500. The employer fee is waived if the non-for-profit company qualifies as non-profit under the U.S. immigration laws.

Me (as primary) and my wife are July 2007 filers and have our EAD and AP till end of 2010. I also have my H1b approved till 2012 but not stamped yet. My wife currently is in AOS status (comp didn't file for her H4 ext when they applied for my 7th yr H1b ext) but she has not used her EAD. We are planning to travel India next month and get our passport stamped (H1b for myself and H4 for my wife). I've couple of questions
1) Can someone confirm getting H4 for my wife will be treated as abandoning her I-485 because she is currently in AOS status? I don't think so but just want to confirm
2) In form DS156 for my wife what should I answer to this question "Has anyone ever filed an Immigrant Visa Petition on your behalf ?" or to be specific I-485 is treated as immigrant visa petition or I-140 is (in which case answer to this question will be no as her gc is applied as dependent)?

I was with company A until March 23rd 2008 and changed to company B (they filed my H1B transfer as well as extension on 03/24/2008 with vermont center). USCIS didnt process my case until mid of september 2008 and my employer B raised a service request. After 15 days of service request i got a query on my H1B i.e on 09/30/2008. Query was replied on 10/30/2008 but haven't received any response until now and aslo the status hasn't been changed in the website.
On the other side my I-94 expired on August 18th 2008. Its been exactly 120 days until now that my i-94 got expired and came to know from others that i can stay in US for 240 days maximum after my I-94 expiration.
Could you please help me out what are the options i have here with respect to the H1B and also regarding the I-94. Your help is highly appreciated. Plzzzzzzzzzzz help me out.

I am starting my employment based GC process. My employer is going to file for my labour certificate (LC) thru PERM soon.
However, I want to know what happens if you Labour Application is not approved by USCIS?
like - Can you then apply for Labour thru another employer? or start ur Green Card process thru another employer.
- Can you get H1 extension after 6 year period is complete?

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and �Net Profit� of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

I recently received my Greencard. Will be getting married in a few months and wanted to find out the options available to sponsor my fiance. Fiance is a british citizen, does that help in any way? Also she is a qualified Doctor in the UK and is planning on taking USMLE part 1 & 2 prior to the wedding. Is it prudent to have her move to the US on an H1B instead?
