First congrats to everybody here able to benefit from this great news. For the rest of the road still loooooooong to go. I'm just starting my labor certification process this month and I'm very new to this whole greencard process. Is there any advice I can have to expedite my application before retrogression hits again. Hopefully it will be a little while before CIS brings us to reality of life. Any help to a poor man will be greatly appreciated.

I am glad that you received the notice. It can be a result of either manual fault or imputting wrong application numbers.

Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.
I had a similar issue.. labor was stuck in the backlog ctr for 4 years.. Tired of waiting - i then directed my lawers to request the dol for a screenshot, ven though my h-1b was valid and i did not actually need it.. lo and behold.. 15 days after that .. it was miraclously approved.. I suggest you try the same.. keep me posted if that works.

Just because some people are not accepting others views they cannot tell their view is correct. This is a Forum and opposite views should also be tolerated. Then there is no need for Forum or Forum rules can tell that only certain messages are allowed. It is upto anyone to accept or deny others views.

Is there anyway we could go about pushing our story in the media? I am sure all of us combined have a a few thousand bachelor's, master's and ph.d. degrees. We are a group of people with highly advanced skill sets and this needs to be advertised. Maybe convincing a few journalists to take up our cause could be an option. Local newspapers, political blogs, radio stations etc. etc.

Senator Frist Bill's bill excluded the controversial Temporary Guest Worker Program and Earned Adjustment of Status of Illegal Alien Program. The good news is that for the gain of politics or not, the comprehensive immigration reform legislation may move fairly in good pace to some observer's surprise. Legal immigration and employment-based immigration reform are clinging on the edge of the politics involving on these two issues.

Sparky I had same experience in 2003 only my next flight was after 24 hours. They refused to accommodate me in a hotel or on another flight though they had sense to issue me a calling card for 10 euros and a meal coupon. I have never flow AF since that day (even if their tickets are cheaper) and neither has any of my friends or family member. Every time I hear somebody is planning to fly to India, I tell them my story and trust me nobody I know has flow with AF since 2003.
I have never flown with them. I always prefer AA and Continental direct flight. Nobody I know have ever flown with AF and now I will make sure nobody ever does.
I hope media in India makes a very big deal out of this issue. They will learn their lesson.

I see that there is a lack of understanding about what "special" labor cert means.In the context of univ profs it means that the university is allowed to justify hiring an alien based on the fact that he was the BEST qualified candidate for the postion - that is, the univ is allowed to reject other minimally qualified applicants. This is currently not the case for other junta in either EB-2 or EB-3 .. if ANY minimally qualified american citizen / PR is found, the labor cert is denied.
If this is extended to EB2 / people with advanced STEM degrees as Frist Bill proposes, the labor cert will become quicker and painless for these folks (not to mention the immigration attorneys and the employers).

I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??
3 years experience period. It is an add on to the point system, if at all the amendment passes. At that point, there would not be any of the labor-140-485 process. You will be exempt from visa numbers, who knows what that system would be.

I am so sorry that IV did not inform you about Donor forum. I will check with IV on why you were not notified earlier. This is clearly unacceptable. IV core should give up their jobs and should start going door to door to inform everyone about IV's goals, strategies and changes to policies.

All this guy needed to do was to search the forums and read through that thread that I pointed him to, and voila, he would have know what is IV's intention on the donor forum. He probably knew about it but just decided to throw some oil to the fire in this current thread. I agree with your reasoning on giving more focused replies but then that's what I'd keep doing all day because there are tons of folks roaming around here who have nothing better to do but criticize IV!

I wonder why nobody takes up the cause for H4 visa holders who are mostly women and who becomes completely dependant on their husbands once they enter this country .With retrogression and the endless wait for GC it means losing all the skill sets that you have and all the opportunites that come along just because you donot have a EAD card. Worst of all nobody who speaks so much about womens emancipation seems to care.

Based on the labor approvals, I am expecting EB2 will touch 2007 in the next 3 to 5 visa bulletins.
I know you have been correct in the past but I think we have just gotten over the hump of 2003 and a small portion of 2004 for EB2. The majority of 2004 and early 2005 still remains. There was a huge jump in March 2005 to beat PERM. I dont understand how it will reach 2007
