My understanding was that once the i-140 is approved then one can change employers. Some kind of portability??!! I dont think u need to start a new once the i-140 is appoved but you can find an employer with SIMILAR job position.
Well in my case the i-140 is still pending.... and i dont have my employer anymore.

I filed my labor twice with Fragomen and got rejected in 2001 and 2002.
Just for H1B visa extension they took more than 9 months. Although they have all my papers for months. Eventually, I had to leave my employer for good.
Stay away from them if you have choice.

Hi all,
This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists. Is healthcare comparable to USA.
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue. But looks like in Canada they value your educations and other qualifications. Can IT professionals (non-managers) apply for Canada PR without a job or Canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?
Please share your thoughts .
Thankyou
Yes salaries and opportunities are greater in US. I am not denying that. Actually
an Indian family friend of mine here in U of T, his wife happens to be born outside
India. I always advice them to keep an eye on opportunities in US, GC is worth the hassle for him.
With 2 kids you get tax benefits from Govt. Yes its hard. But its even harder and risky with
H1B in US. Taxes are high and so I am now planning to work as sole proprietorship
, something that I am not allowed to do in US.
Socialist Health care can never be equal to privatized health care in US.
In Canada you pay in terms of wait times (but not as bad as the private insurance lobby is portraying in US nowadays)
But if it is non emergency and needs long waiting I can get that done in India as well.
Skilled immigration is closed for non IT managers now.
Actually US has lately liberalized the TN1 visa for Canadians. It used to be 1 year but lately increased to 3 years. As H1Bs are squeezed out of US, the demand for non H1B needing people will increase and that can benefit TN1 visa holders.

is UNLIKELY to pass at least in its current form. Public hospitals, underserved area clinics, Universities are not Google and Oracle!!! They'll go under if they have to pay 5000 $ for H1Bs. People probably don't have the faintest idea under what kind of financial strain these are. There will be exemptions for universities and non-profit organizations.
Not only the 5K filing fee , One have to do newspaper advertisement like PERM the cost of lawyer fee and I read somewhere One year extension for H1b beyond 6yrs since I140 will be out of the picture.

Sleuths. Bring out your magnifying glasses, pen-torches. Search the bill and look for 'unused', 'visa' and 'Sch A'.
This vote is a test only and so no time to relax.
There goes the supplemental bill and any hopes of getting any relief by Feb 15th.
http://news.yahoo.com/s/ap/20070213/ap_on_go_co/congress_spending;_ylt=AmFxyhCYs5och8xea1qWeR3MWM0 F
However, logiclife has indicated that there is a very good chance of CIR being debated in the Senate sometime in March so we should get ready for that now. Folks who were opposed to I-485 provision must be having a great day today. :)

Not many goodies this time..thats what all the analysts/experts seem to be predicting.
True, Unless congress enacts a law allowing the usage of unused visa and or increase in available number for LRP, else EB2 with later PD must explore EB1 to get ahead of the EB3's porting to EB2 with old PD :( .. Well, the point is, NO other options except increase in visa / re-use unused visa from past years can help every one here. Everything else, discussed / debated will be a waste of time ...

ClaiGC. Thanks a lot! Wasn't aware of these issues. Yeah, the biggest plus point is -->"EAD allows you to work any type/number of jobs that is the big PLUS though!" I hope this alone outweighs the cons of EAD :-) Freedom from employer slavery. And I assume the renewal can be done by the applicant rather than being dependent on the employer as in H-1.

Sorry you missed the whole point and is side tracking the need of today: stop the grab of unused visas. Pure and simple.

Where did you get that idea? You can only change employer if you filed both I-140 and I-485. And I-485 should be pending for more than 6 months.
And what do you mean you don't have your employer? You were laid-off? or did you resign?

If this amendment can be included, and all our provisions passed, then Bill Frist for president :D
If this does get passed with our provisions and 485 clause, we actually stand a chance of making him president ;)

Thanks for sticking with IV!!!. Its a bit ironic that you decided to contribute to IV only after 485 measure failed, which you were opposing. I agree with your message of unity, but that should hold good at all times, irrespective of whether you agree and do not agree with IV. People holding off contributions, heckling IV, questioning IV rationale when they dont agree with IV is outright selfish and should be avoided at all times.
Couple of days back, I do differed with IV objective to persue only filing of I-485 by Feb 15. Also, one gentleman from this forum asked me to quit IV...
I am of the opinion that "Difference of opinion" to achieve goal is OK but not to loose UNITY...
I did not quit IV but today contributed IV because I beleive IV is fighting for Immigration issues/cause..
Amen...!!

There are always exception in the constitution. For example for US president and Vice President only US Born citizens are eligible. In a way you can argue that is also discriminatory.
If anyone thinks country quota is violating law he can easily challenge that. Green card process is not by merrit. Labor and I140 process is not selecting best candidate. That is just checking whether the position exist and the person is eligibe for that. All of the eligible candidates will get. If no country quota then FIFO process will be applied. It is just cutting the line and not selecting best candidates. So company or country will not have any impact on who gets green card first
It seems changing country quota is difficult. But if cap for GC is increased and exempt dependents then no need to remove the country quota
If law is not consistent with constitution, Federal supreme court can revert it. it is not question of fair or unfair. The point is is it violating constitution?

My current H1B was sponosred through an educational institution and was hence cap exempt. Will I be able to transfer my current H1B if I decide to move to a private company?
Thanks!
When I spoke to my Lawyer about the same issue he said that if the H1B visa was never counted against the quota, you can not unless the visa numbers are available in the fiscal year. He also mentioned that the move into for profit company would be considered as a new visa and should counted against the quota.
Thanks!

There are uglier things than sausages being made. For example, when Bernie Sanders gave a 30 minute speech to increase H1B fees and make H1B program useless, he brought a big chart and the whole enchilada to try to prove that H1B depresses wages.
However, in the starting part of his speech, he said he supports the bill.
The bill brings in 200,000 guest-workers each year (it was 400,000 before Bingaman amendment). However, according to him, that is just fine. When guest-workers come to US in numbers like 200,000 then they dont depress wages of the lowest income group in America. However, when hi-tech workers come here they depress wages.
This is the kind of logic from people like Bernie Sanders and Co. that is uglier than watching sausages being made. Watching sausages being made might hurt your eyes, but this kind of logic hurts your head and can damage your brain's neurons.

You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.
PhD is no trivial thing. One does a phd only if one is truly motivated.
Plus PhD doesn't guarantee EB1 either.
Since 2001 downturn PhD graduates are having a hard time getting faculty positions
as education budgets haven't increased much and therefore faculty positions are very hard to get unless you are from a top school like UIUC, Stanford etc.
You will have to do 1-2 years of post doc at 30K per annum salary to land a
faculty position.
So you are looking at 6 (phd) years + 2 (post doc)years to land a job as faculty
and after that it might take1 years to get GC.
Living on 6 years of 18K per annum salary(Phd) + 2 years of 30K per annum salary (post doc) is no easy.
You are better off working on H1B . At least you will earn more and have a better life.

In addition to monetary contributions, it would be helpful to call the office of your representative asking them to support the bills being proposed. The representative can be looked up by zip code (5+4 digits format) at this site http://www.house.gov/. If you reside in a representative's congressional district (based on zip code) you are his/her constituent.
Constituent's issues/calls/letters are given priority by the representatives over non-constituents. I became aware of this when participating in the recent lobbying activity. The more number of constituents that call, the more likely is the congressman to give importance to the common issues. The anti-immig groups have been doing this all the time. Now it is our turn to beat them with the strength of numbers.
Please contact the representative when the bills are being taken up. This is very important in order to get support for our issues.
More power to IV. Let's get this done.
