Response I got from the Senator.....
Thank you for contacting me to share your views about the proposed framework for comprehensive immigration reform. It is an honor to serve as your Senator, and I appreciate hearing from you.
Like you, I understand that our country's foundation has been strengthened by our proud tradition of immigration, and I believe that people who work hard, contribute to our economy, and respect the law should always be welcome in the United States. At the same time, I also believe our current immigration system is broken. We need strong legislation to restore the rule of law and strengthen the security of our borders and the integrity of our workforce.
As you know, a group of Senators, including Majority Leader Reid, released their REPAIR Proposal (Real Enforcement with Practical Alternatives for Immigration Reform). This proposal outlines a framework of policy recommendations aimed at restoring security at our borders, cracking down on employers hiring illegal immigrants through an employment verification system, and establishing a strictly regulated system for earning legal permanent residency. To ensure enforcement, the framework also calls for increased border patrol personnel, resources, and technology, and lays out a policy for administering temporary work and student visas.
The framework for comprehensive immigration reform has not yet been introduced as legislation in the Senate. Please know that I will continue to monitor the status of this proposed framework, and I will keep your views in mind when the Senate takes up immigration reform.
Thank you, again, for sharing your thoughts with me. I hope you will continue to keep me informed about the issues that matter most to you.
All my best,
Jeff Merkley

Why does Australian govt allow H4 Visa holders to work unlike the US Govt does??????
Doesn't AU government know that H4 visa holders don't necessarily have the same skills as the H1 holders do? May be in AU, there is no provision to change from H4 to H1. In the US, you can always change from H4 to H1, if you want to work. In the US, every visa is different. You just need to get the right visa according to your needs.
I hope this helps people who don't know that H4 to H1 is possible.

Just read the news directly from the liberal media. Read results of polls. You may open your mind then. That's not me saying. As usually you cannot handle reality and get offended by it.

Payback Time
David Corn writes that the electorate has sent a clear message to George W. Bush, his party, his economic agenda and his war: The voters chose not to stay his course. The House of Representatives has been refashioned, the Senate is still too close to call. But the Democratic response to this mandate is yet to be formed.
Democrats will hopefully move in the right direction.
- Some uphappy soul is so frustrated after the result of the recent elections that it is posting trash on these forums. You know who it is ;) Take a deep breath buddy and let the reality sink in.
- We are trying to teach you a lesson by not voting for you. lol :D yeah right.
- These anti-immigrant proponents were predicting a status-quo in the house by defeating any pro-immigrant candidate.
You can't win both ways. It just shows weak logic and confused head.

Very good news indeed.
In the US politics for some reason, certain issues seem to get clubbed together.
Sometimes it suits our purposes and at other times it is vexing. Clearly our issue of legal immigration does not create the type of backlash from conservative republicans that the issue of illegal immigration does. Hence when our circumstances necessitate that we have to try to board the CIR train to our goals I consider it unfortunate.
On the other hand when it comes to H1b immigration, every H1b increase has corresponded with some sort of provision(mainly recapture) of EB visas also. H1b increase has tremendous support and pressure from the powerful capitalist forces in this country. Just see how the Wall street Journal and Pres.Bush gives publicity to this issue. I doubt pure EB provisions can get that sort of visibility in spite of the tremendous work of organisations like IV.
In that sense the H1b cap being exhausted indirectly gives our issue more visibility and is a good development. Lets wait until the 20K US masters cap is also filled, then publicity will increase even more.
All in all it looks good that something will work for us by the end of this year. The pressure is building on congress to do something about EB immigration.

Dear IV members,
We are seeing now the fruits of our efforts.
Update: Bipartisan Bill - HR 5882 introduced to Recapture EB visa numbers (http://immigrationvoice.org/forum/showthread.php?t=18773)
Update: HR 5921 Introduced to eliminate per country limits (http://immigrationvoice.org/forum/showthread.php?t=18856)
Despite a difficult year for immigration, there is movement of Bills for us.
The admin fixes campaign has also been successful. It is now a matter of time when administration chooses to make an announcement. We have been following up with them on regular intervals. The phase 2 of our campaign has also been going for past several weeks. Several state chapter members have traveled to DC and lobbied. Core has also traveled to DC to push for our provisions.
The latest good news is the bill on Recapture. IV has been on the front lines to announce all these developments and our lobbyists have been lobbying hard for us. All this effort costs money and thus we are starting a funding drive after a gap of 4 months so that we can continue this momentum. The more we can raise, the better we can lobby. We have a target to reach at least 50K in this funding drive so that IV can continue to be a voice of immigrants and take up their issues on the hill.
Please contribute generously. We encourage people signing up for recurring contributions but if you want to contribute one time, you can do so too. If you want to contribute an amount not listed on the contributions page (http://immigrationvoice.org/index.php?option=com_content&task=view&id=26&Itemid=44), you can contribute by paypal using the email donations at immigrationvoice dot org
http://immigrationvoice.org/index.php?option=com_content&task=view&id=26&Itemid=44
Once you have contributed, please post on the thread and we can know how much closer we are from our target. IV chapter leaders and Team IV members will run this thread and count the contributions.

Hello,
I have been going through this discussion. I am in a similar situation where I got a Welcome Notice saying my I-485 was approved and I should be receiving my card in 3 weeks when my PD is not current and in fact, the PD is a couple of years behind! It has been 6 months since I got the notice and no GC is in sight. After calling the customer service in March, they told me that they did not have my biometrics in their system and so I had to go for a biometrics appointment early April. It is almost 3 months since then and I still have no GC card. I know that there is a delay in card production, but at the same time, I am wondering if the I-485 approval was by mistake and that is causing the real problem. I am in talks with a lawyer who suggests it is better to correct the USCIS mistake right now rather than getting into complications in the long run. I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.
Could one of you who faced this situation descibe how you handled the situation or how you would handle this situation? In my case, there is no other I-485 or anything filed before and I have never been out of status or had any issue ever.
Thank you.

Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
I checked with the lawyer's office regarding levels I, II, II and IV on labor certification...The thing that determines EB2 and EB3 is what is written on the approved I-140.
For example, if it says 'Mem of Profession w/Adv Deg, or Exceptional ability Sec 203 (b) (2)' it is EB2. So it's what's checked in when u file your 140, and what it is approved for.
As far as levels I, II, III and IV are concerned, it does not matter regarding adjudication. The thing that only matters is either EB2 or EB3 (which is based on 140 approval as mentioned above) for Indians and Chinese in this case...
