Hi friends,
thanx a lott for good news...Now i have a question here.
labor filing date-jun2004
category-eb2
labor approved and i-140 approved in sep2006.waited till now for priority date.
we were not sure about our priority date in the regular one,and my husband's employer agreed to offer us labor substitution,and so we sent papers for labor substitution to our lawyer whose priority date is now current.But still substituted i-140 is not approved yet.waiting for its approval.Lawyer told us that once substituted i-140 is approved,he would go ahead and file our AOS.
Today the priority date is current in regular one.Don't know how to proceed.Can anyone suggest us here?

Why doesnt US govt allow H4 Visa holders to work like Australian Govt does??????
Rather than crying for shortage of Manpower they should utilize the talent already present in the country. Has someone every raised this issue with the senate? I dont think so....and I think there is no forum also to take it up.
This is a pure case of discrimination.

h1 and my wife on h4. we are planing to file EAD and AP somewhere in AUG when we move to other apartments. Please let me know if this is okay or do I need to file the EAD and get it renewed before the earlier EAD is expired. Thanks ...
you can let the current one expire and then apply for the new one, its not a problem,.

They hushed up and approved my EAD in 20 days. Why ???? 'cos So they don't hit Jun'30 and give 2 years. They wanted to milk another 680 from me so they hushed up and sent me the 1 year EAD in 20 days.
I guess we all have problems with USCIS, either with their inefficiency (eg. receipt delays during July Fiasco), or sometime with their super efficiency (EAD's getting approved too fast):D

Hi all,
This discussion is very valuble for people like me deciding between living in Canada as PR vs H1B USA .We all know that salaries in USA are slightly better than Canada .But now the exchange rate is almost equal.
Salary:
Can a person with family(2 kids) survive in Canada with CAD 50,000 / year salary in a place like Toronto.? I heard in Canada you pay 13 % tax on anything you buy .Does 50 % of your income goes in taxes ?
HealthCare:
Also is the government sponsored health care good compared to USA .I mean do you have any wait to see specialists.Is healthcare comparable to USA .
Immigration:
In USA anyone can get a Greencard regardless of their qualifications and it depends how early you enter the GC queue.But looks like in Canada they value your educations and other qualifications.Can IT professionals (non-managers) apply for Canada PR without a job or canadian education?
Canadian Citizenship:
Many people want to get Canadian citizenship and return to USA with TN Visa .In future ,could USA put restrictions on this .?
Please share your thoughts .

Frankly speaking, i am not a sufferer from BEC, but i want to know more about this mess.
Does the FIFO means, they process the applications in FIFO order, Does it mean that they approve also in the FIFO order? I think both processing and approving are different. Whoever got the case with less complications, will first get the approval and whose case got more complications, takes more time. Is it correct? I may be wrong. I think thats the reason why 2004 PDs may come out BEC fast sometimes as they put the case strongly and clearly.

We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let’s get IV’s attention and support in this area. Let’s talk to AILA. Let’s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let’s write to media personnel. Let’s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.

This question is not to undermine the effort, which was tremendous but just from a realistic point of view...
I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?
Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?
If the same question has been already raised, please ignore.

If I take the card for granted and started utilizing it, how am I voilating my status. Isn't this USCIS responsibility to make sure that they issue properly or not. The applicant might never know whether his PD is current or not. In this case how could USCIS can take your card back. If they can, Can't we sue them ?
and my attorney said "If you were to pull up to a ATM and withdraw $100, but for some reason the machine spits out $1000, what do you do?". Well, you can keep the money and drive away or walk into the bank and give the 900 dollars back. But if you are caught of not returing that money latter then that would speak about your wrong intention by itself. So at that point you may be actioned based on whatever law exists. In this case however it is very clear, USCIS can revoke your green card anytime.

If yes,then they might have taken that PD.
If not,maybe we can see a forward movement for PD for EB2 in coming bulletin as USCIS might be trying to use as much visa numbers as possible.

No its I-485 I just cut and pasted the two emails I received, first at 10am then the second at 3 pm check online and the system had same messages. If its true I am having a party wow man thanks I did come to US in 1997. I do have a labor which was approved under RIR PD date 2004 but the employer refused to file I-140. EAD is free only for post July 30-2007 filers. We are their forever cows, they'll milk us as far as they can. Otherwise somebody tell me why 2 year EAD why not 3, why not 2 year AP, why june 30 for 2 years EAD why couldn't they do it with immediate effect or may be 1 week from announcement. They just bought more time to process everything with 1 year
