EB3 porting is a loophole like labor substitution.
when I came here 6 yrs ago, I had the option of applying in EB3 with a top 4 consulting US firm and I did not want to go that route. I waited until 2010 to apply in EB2.
Looks like People should come to the US as freshers or with 1-2 yrs experience > Apply in EB3 > Gain 5-6 yrs in experience > Port and BOOM, you have your GC.
How can people claim PD porting at a later date when they were not eligible on that specific date in the first place at that time? I know it's legal just like Labor Substitution.
You came here 6 years ago and applied for your GC only in 2010. Didnt you find an employer who would file one for you. And you also know if your GC gets screwed for some reason, then you are out of the US also.
Looks like something is missing, Dear.
6 years ago, in 2004 (2010 minus 6 years), there was no retrogression. And you didnt apply though you had an option. Very very funny.
Tell me, what are the facts.

Although I raised questions about the donations earlier I thought it was time to donate as I was impressed with the email Senator feature and have been helped by IV thru various threads.
Hence I donated $50 to IV !!
I would encourage other non donors to donate as well......its time we all did instead of questioning IV.

140 reached NSC on July 11.
Receipt date is July 17, attorney says they got it today, July 24.
So for those at NSC who filed within a day or two of me, mght be better to hold off for a couple of days before filing 485 with the colored sheet which will probably add some delays in the mailroom
mine reached NSC on July 16th...hopefully i ll recieve it by next week.

Hi Franklin,
Thanks much for your valuable feedback, and I agree to your points and suggestions.
Regards,
IK
You do realize I will hold you to your last point now though :)
To the people that did attend, I re-iterate, please don't judge people who post their honest opinion. We should take this opportunity to learn why people choose not to come so we can improve our strategy for next time.

of course they will accept them
and they will accept your 485 and AP and EAD...
as long as they can cash the checks.
the law has not changed, no one can presume what will happen
it's just that we are the fools in this, spending thousands of dollars without any choice in the matter, and then in one sweep all of it will be laid waste and we will be starting again...
what's more, for the indians among us, with the merit system, when with 90 points on board you will have no assurance of ever getting a green card.
what a alife :-) :-( yeah both, i can't decide!!

Credit cards are issued mostly to GC holders only unless they have a checking account as well with the institution-unless one lies in the application. You are also presuming a 100% credit worthiness and sign up rate - extremely optimistic. This would work when IV is about a million strong and if people like you and me become 'resident' aliens - and dont turn our backs on those behind us.
Many banks in the US will not allow you to add additional accounts like CD account etc ONLINE unless you are a GC holder or a citizen. They ask you to go to a branch to open an account. This is even when YOU are an account holder with the bank for a number of years.
One way of supporting IV and feeling good is to buy some IV merchandise.

Including the House session and Conference session, if somehow this is pushed beyond October 1st 2007, then the enactment will happen on October 1st 2008. We have to hope for that. That gives best possible window for all BEC, PERM-BEC candidates and people who have not filed their I-140s yet.
The impact is on H-1B renewals beyond six years, with the cut-off proposed at six years. The only exception for renewal beyond 6 years is given explicitly to people who applied for immigrant petition. So BEC/PERM-BEC people should apply for I-140 asap.

Here are all the LC approvals for India in the last seven years.
Year, Total LC Approved, Total India
2007 85112 24573
2006 79782 22298
2005 6133 1350
2004 43582 No Info
2003 62912 No Info
2002 79784 No Info
2001 77921 No Info
2000 70204 No Info
Lets assume about 25% of pre-PERM LCs are India based on post-PERM data. Thus for fiscal 2004 (Oct 2003 thru Sep 2004) the total LC number is 43,852. Assume 25% of that to be India based on PERM data. That gives about 11,000 India LCs in 2004 alone (All EB categories combined). If you assume an average of 2.5 dependents then the number of visas required for all India EB categories for 2004 is 27,500 (11,000*2.5). The regular quota for EB2 and EB3 is only about 3000 each. That means 21,500 visas have to come from somewhere. I dont think those many visas are remaining for this year. Be prepared to see FIFO thrown under the bus and approvals with PDs that are all over the place. Please critique this analysis without piling on. Thoughts?
good post but The regular quota for EB2 and EB3 is only about 9,800(7% of 140k visas) each

What regulatory or legislative changes (including a possible pre-application filing procedure for adjustment cases) are recommended to facilitate caseload planning and make optimum use of U.S. Citizenship and Immigration Services adjudication capacity?
By the way, we will have minimum participation for this as most of guys/gals in this forum are on EAD(you will know this when you see amount of questions answered for someone EAD and all H1B related questions are usually buried under within an hour or so)...
Indeed it seems very few people are interested as most member may have their 485 submitted already. EB immigrants are a small minority of this country, yet we are only a small portion of this small minority. It is a sad fact, but it should not stop us from fighting..

Canada and Australia are good backup options. You want to apply for one of these countries as a backup while waiting for your GC.
going by the current EB 3 india scenario,I think canada and australia seem to be good 1st and 2nd options respectively and I will keep US GC as the last option as it looks more far fetched than the other two.

Are you from different world. Yes it is necessary even to get the H1. Now I understand why the anti-immigrants are targetting us. Do you mean to say the English speaking people diminished this country. Can we replace all these guys with mullas. What are you trying to say..
Hello ... I m responding to a some one who dis-respected my fellow citizens . So what do you say English speaking guys are great IT professionals ? To work on computers you need brian and understand bits and bytes not english .
I think you got my message wrong all I m saying is you dont have to be a great english communicator to qualify for EB2 , unless you are applying as professor .
In 70s most of the towns having only local language schools and stuided in local language schools , thay may be part of reason why some of them dont communicate well ..That doesnt mean they can not work on computers ...

mheggade, ur calc looks good but with the exception of Level II, I think most of the people who got Labor with MS+0 (or +1...) will have Level II. my attorney applied MS+0 even though I was having 6 yrs of exp when I applied.
So to say, Level II is to decide on salary level...not only skill level(i understand there is a co-relation b/w them). Most of the consultants will have low level so as to keep themselves safe and keep low level to be safe.
I guess this is what DOS is looking at.
April 2004- March 2005 All countries & all Cat: - 905
(This can be ignored)
2005 PERM EB2 India/China
(Level III & Level IV):- 729
Late 2005 to 01 June 2006
EB2 India/China ((Level III & Level IV)):- 7037
Total labors: - 8671
Assuming 80% of the total made it into 140/I485 stage
New Total of labors: - 7000
7000 labors * 2.5 visa per family
Total expected Visa demand: - 17500
Assuming 80% cases are ripe for approval.
Total visas required to clear the case up until 01 June 2006 is
14000

Air India has the newest Boeing 777 LR non stop from JFK to Mumbai and Delhi. You can get tickets as cheap as 1000 usd roundtrip in economy.
Cheapest business class where you can SLEEP! 3500 USD roundtrip to India. Find a cheaper business class where you can actually sleep and let me know.
Best food! undoubtedly. New entertainment system with lots of Indian movie options.
I am not sure if old sayings apply to Air India.
Also we have jet airways , whose international service is in same class as singapore airlines, emirates and virgin atlantic.
So why are we wasting time with such moronic european airliners? who cant let us sleep one night in their country.
This year, I flew Lufthansa as that was the most viable option for me. The flight from Germany to Mumbai was substandard but the service was ok, cant complain. People were friendly at the german airport.
In 2004 or 05, I flew air france one way on reward ticket, the FAs were rude to Indian customers but overall flight experience was smooth , comfortable and without hassle. People at french airport were ok.
The lufthansa ticket was 1640 rountrip. I also considered air france, first they quoted me 2200 USD and then said, if I could compromise and flew alternate dates, fare would be 1840. The ticket agent sounded as if he was doing me a favour. No wonder when I showed up at the airport, the air farnce flight was almost empty whereas there was a big rush on lufthansa.
CHANDU - I see airline is responsible for this. It is their duty to prevail on authorities otherwise why are they asking for business from Indian customers? In 2004 Delta used to fly via france and my brother had missed connection, he was provided hotel by delta in france for one night. Good that delta got fed up with european visa rules and started new non stop service.

The real reason people are treated badly at Indian Consulate is because there are Indians working there!!! Every where you go, the first thing an India sees is the skin color. I went to Atlanta to a sweet shop run by some Indians, there my 4 year old saw the water dispenser and asked for water, they had some use and throw paper cups and a steel cup tied to the water cooler (just like in India). I took the paper cup, suddenly the guy came running down and started cursing that I am wasting the paper cup? I asked who the paper cups are for. The answer comes as others. This is not a one off incident, be it Air India, Temple, Restaurants, its the same thing. Indians have such an inferiority complex and they are just freaking jealous of every other country man.
On the other hand, Indians have 0 people skills and have no clue how to act on a public place or do they have any concern for others. I took my son for Kumon yesterday. As in any Kumon, majority is Indians, the hot topics yesterday was politics, dinner and how work sucks. They were discussing this so loud inside the establishment. Kids were trying to work and there they were arguing, laughing, its just pathetic.
So, what I am trying to say is, if you are trying to take this fight with Indian Consulate, is it really a one off thing..

although "technically" it is the congress (both the house and the senate) that makes legislation, a.k.a. any new laws or amendments to existing laws when it comes to immigration matters, the role of the president, especially a popular president cannot be underestimated.
If the president decides to throw his full weight behind a particular bill or treaty (as happening with the US-India Nuke Deal), he can (especially a popular president in his first term next year, whoever he may be) influence a lot of congressmen/senators to rally behind such a bill. In that regard someone with a bi-partisan reach can garner even more support from both parties.
That is why it is IMPERATIVE that whoever the next president will be, that he is SUPPORTIVE WHOLE HEARTEDLY for legal immigration.

Desi,
Time and again I have noticed that you backed your suggestions with relevant documents. I for one, commend you for the work you do on this forum. I was almost thinking this case might set a precedent for dormant H1B, but apparently not. The other information that you provided on the other forum that was completely new to me was, when you pulled out the document regarding GC for the child of permanent resident born abroad.
Thank you for good work.
Thanks so much for your kind words of appreciation.
I believe in sharing my limited knowledge of immigration laws and cases with fellow legal immigrants.
