Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

I understand - I took it all as a healthy debate, I certainly didn't intend to offend anyone. Its been one of the most interesting debates I've had in a while. Hermione, I sincerely apologize if any of my posts have been interpretted otherwise.
I agree completely with Hermione. Look at the data. It is clear that USCIS is processing applications "quickly" (I quote the "quickly" because I mean relative to other bureaucracies).
The average time for processing (not including NC, since that isn't within USCIS control, is approximately 120 days). The goal is 180 days, so they are meeting targets (you can argue about the target if you like, but in Canada the processing is more like 220 days).
The stupidity of giving more and more money to USCIS to speed-up processing, when they are already meeting the targets can not be overstated. The problem is not with USCIS, it is with the fact that there aren't enough visas, and that NC process can take years. If you want an answer to "the problem" you need to make sure you are asking the right question...
Of course, USCIS management doesn't complain about the additional funds they keep getting (what self respecting bureaucrat would?).

A couple of months ago I joined company B and they transferred my H1B.
Now if I want to go back to Company A, do I need to transfer my H1B again?
Company A has not cancelled my H1 and I am in good terms with them.

This letter has no mention of the problems regarding permanent residency, it only refers to the H1-B quota issues, we should contact the Congressman Shadegg to clarify that its not just about the H1-B, the problem also lies in the immigration process of skilled workers. If this is not part of his bill then we should urge(request) him to include this.

Here is my list. #1 is unprobable till 2009, so may be we can work on 2, 3, 4

Everybody knows exercising is good. However, it is not easy to see the results of exercising. To see the results, you may have to stop exercising and then only you will realise oh, this is what exercising helps me not become.
If you want to sit and say, let the exercise show me the results and then I will do, well it's up to you. If you are happy the way you are , fine. But, don't knock the exercise.
Personally, I am not desperate about GC, so I never contributed except for 2 instances. One was a 100$ thank you gift for the SSN that came with EAD that got me additional 600$ tax refund. I felt IV has atleast has something to do with the visa bulletin reversal. Some may say, it could have happened even without IV, and may be correct.
The other time is 25$ for FOIA, where I was curious to get a clear picture of how many people are in the line before me.
Now, eventhough I don't believe in all other activities IV is doing , I don't go around knocking them down. I am sure they are trying to do the best they can and the best that they can think of. They always have an open invitation for people to join them and get involved. No, we don't want to get involved, get our hands dirty,but we want periodic updates and continuous progress.
Well, goodluck with that.

I got my EAD card earlier this week. My validity is 6/19/2008 -6/18/2009....it is the same day as I recieved EAD "approved" notice via the CRIS email. My "July Fiasco" EAD expires 9/16/2008.....so yes I lose 3 months!!!!

I dealt with Fragomen for last 7 years. I can say following about my experience �
I work for fortune 500 company and Fragomen was the law firm my company used until early 2007.
1> The emails, voice mails I sent to them used to disappear in a �black hole�. I had to wonder whether and when any response will come to an urgent, time sensitive question.
2> Many times after waiting a week or so for response I had to escalate the matter to my company�s legal department to talk to Fragomen. This used to work like charm, I used to get answers within hours.
3> I had to keep them reminding them about next step to take, as delay from their part had cost me years in the processing.
4> I think many of my co workers had similar experience and that is why my company finally switched to different law firm in Jan 07.
5> I hoped to never to deal with them again but �last week I got invoice from Fragomen for something the did for my case in Jan 2006! I don�t know why they sent it so late and why directly to me instead of my company. Well, this time I am going to wait until they call me to take any action on that invoice.

I think this is a great idea.
This is the holiday season and what better way to touch the chord of the Senators and House members but send one Christmas tree to each one of them. I am sure this would be a very emotional (in a positive way) appeal from IV for our cause.

If anybody has experience here please answer the bellow Qs:
01. If I-140 is revoked by the previous employer after invoking AC12, does the status of I-140 changes? Any LUDs?
02. How long does it take to revoke an I-140 after the employer sends the withdrawal request?
usually you get an LUD on 140 and 485 at same time. When does it happen? Depends, for some people it happens after a few weeks for some, few months.
In my case it happened on Aug 5th whereas my ex employer informed me he is requesting revoke on July first week. Apparantly - the same time my 485 also seemed to be being processed because they sent FP notice to my wife and NOID to me, we are JJuly filers and never got FP notices. When I called customer service, they advised that wife can go for FP and I have to respond to NOID and advised me to respond ASAP to continue with the case. My response reached on Aug 25th and I saw soft LUDs hitting my case continuously for 3 days - guess it is with an officer, but never got my FP notice though my wife completed it.

And then there are some that post messages in the news article thread that are simply wrong and inaccurate. Some people are still in third grade...they believe everything that they read. And believe everything that they hear on TV or the radio. If Chris Matthews or Bill O'Reilly is your source of accurate news or objective analysis, why, even the heavens weep for you!

Based on last week's BusinessWeek article, I have a feeling that we will see an effort to restrict initial H1B applications in some way. That would be a good opportunity to push for allowing naturalization applications for people who have been on work visas for a long time (say 8-10 yrs?). Fighting for citizenship would have a stronger emotional dimension and may connect better with the American public. A direct filing for citizenship will work around retrogression by providing an avenue for people to move out of the GC queue.
