I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.

i too got an email saying card production has been ordered....
was overjoyed....
few days later I recieved a cover which almost looked like it could be the card...
I was about to open it that my wife woke me up saying...."it's time to go to the office, get up"
I had an arguement with her after that saying...you should have waited 2 more minutes before waking me up....we would have had a gc if you had waited.. !!
anways, back to square 1.

In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).
Sitting at home and taking care of kids for long, can drive a capable/educated individual to psychological issues, which can overall have an impact on family as well as the mental wellbeing of the breadwinner.
What happened to all those Equal rights for women/dependents etc etc groups in the US? Ofcourse I am not saying that all H4 people are women (the majority is women)

Just curious, and thinking loud: if there is a limited and reduced number of H1B workers come in, in the long run the number of applicants for permanent residency will be shrinking too (at least EB category). To reduce EB GC applications, and preserve the americanness of the employee-pool, this seems to be a nice and covert trick, at least to me. Let few people come for 6 years, and so fewer may remain as GC holders. Maybe I am missing something here.
When they reduce H1 B why do not you think about reducing immigrant visas like EB based.

'Too many Cooks spoiled the broth'. If each person steering the boat paddles in a different direction, boat will go in circles.
True to certain extent but I don't know that there are too many cooks. We are all making suggestions but if there is any action based on that, we don't know. It's sorta brainstorming and some good ideas may come out of that.
If we stick to 'Don't ask what we can do for you, ask what you can do for us', we won't go far with it.
I have had other people express the same thing to me. It's about the collective group but if we cannot convince individual folks there isn't a way we can gather the group. We truly need to be proactive in recruiting people to the organization actively as opposed to being passive and saying it's fine - we will let whoever wants to join us join and whoever wants to contribute let them contribute.
I think as more number of people join this organization, the responsibility increases for the organization too. I also truly think the anonymity of the members is truly not helping and is in a way responsible for all the offensive posts in this forum. Once you attach a face and name and location to the IV handle, some of that should stop.
Also, make this a paid forum, please.

If there any IV volunteers around DC, it would good to go his DC office and if possible meet the congressman itself to explain our case.
I am willing to do it. I did call up the local senators and congresspeople about supporting the bills. I have asked the GM of my company to give me some political contacts (am still waiting on him) since he had recently gone to DC to do some lobbying for small businesses. Let me check in the DC/MD forum and figure out who we should target/meet.

Did you apply in EB-1? If not, then .....
I don't want to scare you, but this could be pose problems for you down the line. Check Murthy bulletin....Murthy explicitly asked USCIS to revoke this earlier decision of GC approval for a client whose PD was not current....a case very similar to yours...as they anticipated lots of issues down the line. The topic of the bulletin if i remember correctly is "when GC approval is not good news" or something.
This was a USCIS error and there's a high probability will be cought sooner or later, at which point USCIS will revoke their earlier decision.

Note that list of occupations changes constantly. I lived in Canada for 20 years after coming as PR on point system. It works well there, if you think money is not everything. Education is equally good. People, of course are far nicer and friendlier. Even border immigration and custom staff show a friendly face and attitude..

The main immigration bill was in 2002 called IRPA. What it did was give the rule making authority to the executive branch from the legislative branch. So unlike US, after 2002 IRPA rule in Canada, if there is need to change the rule (eg add occupation list) it does not need the legislature to pass the rule change.
On the whole rules have been tightened. The main problem was that more people were eligible and applied than the annual quota. Now they have pretty much restricted to people who have studied or worked in Canad or belonging to skilled trade occupations.

I had the same question so I asked my attorney and he told me that you can "transfer" your H1B after Oct 1 and benefit from AC21, meaning that as soon as company B files an H1B petition for you and you have proof of this filing, you can start working for them.
However, I understand that you want to "transfer" before Oct 1, in which case company B has to file a new H1B petition either regular or with premium processing. This new H1B is not counted against the cap because you have already been counted against the gap in the 6 previous years.
In short, you should be able to work for company B starting Oct 1 if they file for a new H1B now and it is approved by Oct 1.
I recommend you ask an attorney for your specific case.

I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.
And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. Thats just rhetoric from the likes of numbersUSA and lou dobbs blindly being parroted by some morons/idiots/imbeciles here. The core team had repeated this several times when CIR was under discussion. What u can do ask your employer/attorney for the copy of the check cashed by TSC/NSC for I-140 and if u look at the back of it you will find the receipt no. That receipt no. is the same whenever u will get ur NOA so make the photocopy of front and back of the check and submit with your I-485 application and relax

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.

Yes. If your visa is current in July. Then you have whole July to apply. Even if you deliver on Sundays. but i have no idea whether they accept application on Sunday's..

I tend to agree. Anything that can give us positive publicity will work.
The flower campaign was a huge success. The holiday season is here and I was thinking about a potentially new and innovative campaign idea. Greeting cards with a recorded audio message to be sent to the Director of USCIS. The message would be unique to the individual sending it. Should include something like "Dear Sir - I wish you a happy and safe holiday season. My name is "xyz". I am a legal immigrant stuck in the green card backlog for "xyz" years. Please help us. This message is just an idea - it could be anything agreed upon by consensus.
Maybe this idea is a little corny but we have to think out of the box. Just imagine - hundreds of greeting cards with their own unique message - could make a point???

It is terrible that AF treated its customer like a piece of Shi$. I have never flown nor shall ever fly in that crap airline.
I would like to suggest one thing here. We (Indians), mostly, and I dont mean to generalize here, don't bother to "WRITE" letters to the company to express our dissatisfaction or frustration. Partly to blame for this attitude is because of the system we grew up in India where even if you complain we don't get any response, mostly. The customer service is lacking. So, in that mind set we most often feel its the same with other countries.
But I strongly feel, sending a letter to express our outrage would definitely bring a positive change. The Govt. of India, should intervene but, lets not keep up the high hope, its not going to happen....they are all busy making money to buy land, home, comercial complex, marry their daughters and sons extravagantly and endless greed. So, realistically, the Indian Govt. is not going to intervene. Shame on them!!!
Moving forward, I strongly urge all the folks in this thread who had a bad experience to write to AF and vent out your frustration and pledge not to fly with them ever again, and those of us who heard this story, just send an a mail to express the shock and question if we could also face the same situation should we decide to fly in AF.
The poster who send a mail to AF with the "B" word, I applaud him. He even got a response!!! Wow!! that's the magic and strength of writing. Trust me it works. Just write to the airline, expressing or venting out your frustration. Just one line is enough, if you think its not worth the time.
I felt like writing this comment because I don't want to be discriminated or treated differently(badly) because of my ethnicity or color.

It is USCIS that decides the categories and it is they who say that EB1 is more skilled and valuable than other categories
Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...
If things make you sick .... there is a fix for it .... go to a doctor ...

Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.

It is USCIS that decides the categories and it is they who say that EB1 is more skilled and valuable than other categories
Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...
If things make you sick .... there is a fix for it .... go to a doctor ...
But truly... I do believe you are sick, inability to coherently digest a discussion and think is a serious anomaly and you should get it checked out...

How many people in EB2 do a different job from EB3?
Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.
For jerks like u to come and talk abt people in EB3 being unskilled, makes me sick.

In addition to monetary contributions, it would be helpful to call the office of your representative asking them to support the bills being proposed. The representative can be looked up by zip code (5+4 digits format) at this site http://www.house.gov/. If you reside in a representative's congressional district (based on zip code) you are his/her constituent.
Constituent's issues/calls/letters are given priority by the representatives over non-constituents. I became aware of this when participating in the recent lobbying activity. The more number of constituents that call, the more likely is the congressman to give importance to the common issues. The anti-immig groups have been doing this all the time. Now it is our turn to beat them with the strength of numbers.
Please contact the representative when the bills are being taken up. This is very important in order to get support for our issues.
