My colleague is EB3-I with priority date in early 2003. He is in the process of porting to EB2 instead of waiting for his date to be current.

I've had some pilot training, so I'll chip in.
All commercial planes have advanced information of a thunderstorm way before it arrives. Most of the airlines/pilots take a detour to avoid it. That increase expense (extra fuel cost/arrival delay, passenger compensation, delay in subsequent flights, etc.). So, the chepo airlines will take a shot at simply going through it. Risk for a big modern plane is very very small but non-zero. An airline making a decision based on costs instead of ethics will pressurize captains to go through such storms.
The lesson is simple: avoid AF. You'll have to be an idiot to fly it or a cheap airlines like that.
Its a terrible tragedy when lives are lost. My heart goes out to the innocent victims and their family and friends.
Air France is conveniently blaming it on bad weather but I don't buy it...planes fly just fine in bad weather...at least well maintained planes. While their incompetency at customer service clearly shows, they are probably sub standard in maintenance and safety issues as well. Too bad innocent lives have to pay a price to bring that out.

I and my wife got our approved EADs in our hand in 17 days (Mailing day to USCIS to recevied date by us). Only strange thing is that my EAD is valid from 06/2008 to 06/2009. I thought the new EADs validity would begin when the existing expires. My existing EAD expires on 09/19/2008. I lost 3 months with this renewal.
USCIS has been unfair in renewing EAD.
What about writing a letter to them? - by grace of God, if they do realize, they may give properly - for 2 years.

Here is how I made up my mind to go to the Rally.Most of us waited for an average of at least 3 years in my case, this is my 10th year waiting to get a Green Card after two failed attempts of starting the process and changing employers in 1999 and 2000 and counting. All of us really don't know how many more years do we need to wait and getting extensions every year, either for your visa or for your travel Parole, or your EAD. Most of us are tracking our receipts now, why, because we don't have a transparent system, did you get an LUD, Did you get a FP notice how come I did not get one, where is my application, did your application get to TSC, was it transferred to NSC, what did your lawyer tell you, why did my lawyer tell me this way.
Why are we all passionately managing and exchanging so much information, because we have no clue what is happening behind the scenes. All of us know there are a very few who will get a green card tomorrow, but for most of us, we keep tracking to see anything in the change of status. Feeling uncertain is not a good feeling, I felt it for the last 6 years. How long will an employer wait patiently for you, how long will your wife wait to see she can work, how long will your in-laws respect you when you said during marriage, oh she will be able to work very soon:), how long will you keep convincing yourself, everything will be fine if I just sit and do nothing?
THAT IS WHY I SHOWED UP, THE SENSE OF SATISFACTION IS IMMENSE TO STAND UP AND PETITION. TO MEET LIKE MINDED PEOPLE WHO HAVE UNDERSTOOD THAT DOING NOTHING IS NOT AN OPTION!
But the feeling of "being uncertain" made me go. The excitement that I could meet so many many of you who work selflessly and volunteer so much of your time was priceless.
When we finally reached there, we saw moms, who had kids volunteering, sometimes we had babies, kids in the situation room helping mom organize things, we had people drive from far places, leaving kids in neighbors/baby sitters home and had to drive back late night for 2 3 hours to get back to them. We had people hit the bed at 4 am in the morning and show up the next day all suited up and ready to meet lawmakers at 7 am. That made our trip look so simple!
Guys we respect everyone's reasons, yes we do have lots of genuine reasons and it is not for me to judge personal reasons on how important they are. The point I am trying to make is purely this, think it through and see how you life was or will get affected by this process. Many of you filed your 485 and are instantly gratified that things are fine. I can't stress enough that this is not the case. When I got to file in June I was very excited, I used to see LUDs, FP, got EAD, Travel Parole and everything and then nothing happened. It stays there and from all the statistics, numbers and logic that we all apply, it will stay that way for years. If you think you are out of the woods, think again, all it did was from one stage of the clog, now we are clogged to the other stage of clog. If you think you are now easy to move around, change your jobs, think again. It is extremely complicated with no guarantees that the USCIS officer will interpret your job duties that same way!
Sometimes during discussions we all think, what is it that is stopping you all to come, sometimes after working so hard there does happen a feeling, what reason is big enough for them to not show up, when we did. So please don't get offended either way, we want all of you, we want everyones support and keeping egos asides, lets think how best can we speak in one Voice! Just getting the provision to file AOS when priority date is not current without the other provisions that are related to pre filing AOS like "removal of semilar\same job restriction when using EAD\AC21" is not good. Dont get me wrong I understand how much the guys who missed out on the july fiasco want to prefile AOS and get EAD but without the provision to remove the restriction of same\semilar job requirement in AC 21 it (EAD) is useless. By now everyone knows that USCIS is heavily issuing RFE or denial notices for h1b transfer and extension. It is just a matter of time before USCIS starts issuing RFE or denial notice on EAD\485 as well. The prime candidate for USCIS to kick out people using EAD\485 is the same or semilar job restriction while using EAD\AC21. If everyone gets to pre file AOS without PD restrictions then USCIS will make using EAD as difficult as using H1b. Please fight for the removal of "same\semilar job requirement in AC 21" along with prefiling AOS so that everybody gets true relief and it really becomes a win win situation, otherwise it is a waste and will speed up uscis making life miserable for EAD workers.

We have consistenly advocated for this provision which we believe will curb arm twisting by bad employers, that are like few bad apples in the big basket. Such a provision will help everyone including USCIS, lawyers, genuine companies, and direct+indirect beneficiary. Its a win-win for all.

Just reporting what I saw on CNN. During the Sen. McCain interview with Judy Judy Woodruff & Richard Stengel, Richard asked something like - what about the green cards for the highly skilled immigrants educated by American Universities. To this Sen. McCain replied implying - they should be given green cards sooner, I am not sure if they could be given automatic green cards but the process should be faster.....
He said it not exactly in these words but implying something to that effect. They were suppose to ask Sen. Obama the exact same questions. Did anyone see Sen. Obama's answer to the question about green card for high skilled immigrants from Richard Stengel? Just curious....

There is no future for EB3. I have PD March 2005 but still have to wait PD to be current and then i have to apply for EAD. Where as my JOB requires EB2 but employer filed only in Eb3.

IV, I am afraid, will NEVER earn the right to say " dont expect people to be courteous and receptive ". no successful entity will ever EARN that, leave alone a grassroots support seeking movement.
I assume you are not speaking for IV core and move on, we all have tasks to do .

I agree ---- I think the momentum is slowing down...
at least can we not take any legal action for issuing out a rule (you can file MFS and get the stimuls and then amend MFJ) on 04/14/2008??? what about people who filed a long time ago as MFJ?? Because once you filed MFJ, the action is irrevocable!?! In my honest opinion, this stupidity of issuing out a clause the day before filing deadline deserves some "stir"!!

Its only going to take 5 people to break away from the 64. Those 35 "No" votes are the ones who want CIR dead NOW. They are not going to change. But those 64, its only going to take 5 people to walk away.
There are 24 amendments. I think atleast 5 people would see their amendments fail on the floor of the house and probably another 5 atleast who would withdraw support because someone else's amendment passed. This baby is going DOWWWNNN this weekend per my estimate. I could be wrong but again, 24 amendments ? That's too many darts on a fragile compromise.

The attorney of the new employer says, that I can start working with new company once USCIS receives my application. Is it safe? She says Fedex tracking no. is enough. Did any one face this situation? pl.respond. She got instructions from the employer to apply in regular process.How much time it will take to get a receipt no. in regular process?
Once you get a reciept notice, you can start working, but to be safe, you maywant to wait till approved. If the employer wanted you badly, why did they not file in PP?
