If you are employed in IT field, as far as I know federal skilled workers and AINP H1b stream are almost blocked except for managers. Canada immigration program has a list of occupation category; if you work in one of the listed classification then you can apply for PR. About an year back federal skilled worker deleted all computer related classification but managers. In May 2009, AINP did the same and now only IT managers are eligible.
If you are employed in non-IT category, you may still be eligible.
But AINP looks "little" better when compared to other immigration programs.
is it mean Canadian door's are closed for people who employed in IT field and do non-managerial job?
Is there any other alternative option to apply Canadian PR after exclusion of occupation category from federal and province Skilled worker category?

1. Let us decide how we need the data. ie what query USCIS has to run
2 make publicity of this .. ie uscis is an agency which should have the data but it is asking us to pay 5K for the data. (president, hillary clinton, aila and whoever else,...)
3 Only getting this data one time wont help us. Like USCIS processing dates , they have to run our query every month on a particular date and publsh it. Otherwise after 6 months or one year we have to pay this money again.
4 Can we appeal to the money asked by USCIS. Anyone who knows more about FOIA
5 Can we request USCIS to give us the table details and tell them we can write the query/program free of cost.
Any other suggestions..

I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.

I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.
Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.

See the Total Employment Based Visa approvals for 2006 and 2007 159,081 and 162,176. But there are only 140,000 visas in EB category. The rest of the visas came from Family Based visas which are not used for the previous fiscal year. The share for each category: Each EB1, EB2 and EB3 should get 1/3 of 140,000 = 46,666. But due to the less demand in EB1 and EB2 ROW all the visas falling to EB3 ROW due to the Vertical falling.
EB1 ROW --> EB2 ROW --> EB3 ROW.
EB1 INDIA --> EB2 INDIA --> EB3 INDIA.
As theres not much demand for EB1 ROW and EB2 ROW, all the unused visas are going to fall to EB3 ROW. So from this time its going to be like Horizotal fall out like below.
EB1 ROW/EB1 INDIA --> EB2 ROW/ EB2India/ EB2China-->EB3ROW/EB3 INDIA.
So this time to fall any VISAS into EB3 ROW they have to pass through EB2 India/EB2 China. So this makes EB3 ROW dates would retrogress due to the decrease in visa numbers availabilty.
As I said each category would have 46,666. So EB1 and EB2 together will have around 93,332 visas. But in EB1+EB2 in 2006 about 50,000 visas approved and in 2007 about 70,000 visas approved. So for 2008 also asume the demand for EB1 and EB2 is 70,000. But the availability of VISAS are 93,332 as said above + unused family visas which come around 19,000+.
So for this 2008 fiscal year for EB2 India and China the total visa numbers availlable are
(93,332 +19,000) - 70,000 = 42,332.
So around 42 thousand + 9,800 (regular 7% of 140k) = around 52k Visas Just for India , because EB2 China was already Jan 2006 a year back. And I dont think it would take any considerable share in this 50k other than its regular 9,800 visas.
Get me back if you have any doubts.

They filed my H1B and are about to start my green card. The H1B took forever. I wish my company allowed me to do the H1B myself. I can do a better job without a lawyer instead of paying Fragomen $5000 for rubbish.
Once, they kept sending out emails per my H1B application and copied my company using a wrong email address. This stalled my start date as my company never got these emails and I kept calling them. I thought my company was ignoring me but it was Fragomen that kept using the wrong email address.
I wonder if my company would allow me use a personal lawyer for the GC process.

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

mine is fragomen . they are pretty good...and have been working 24 by 7 in shifts to prepare forms. they are very responsive and very good people to deal with. surely recommend them.

I want to thank this european who got his greencard 2 weeks back but still attended the rally. There may be more heroes like this. I was in a group of people when we spoke to him, didnt catch his name as i was encouraging bypassers to honk their cars to support our cause.
He is over 6 foot, in immigration voice t-shirt and blue jeans. He is swedish...Please share his name if anybody knows....
I was the guy from Sweden. I agree with the Russian student.
The reason I was there was because my green card process was a painful and stressful experience for 5 years. And I was still one of the lucky ones! I don't want to put anyone through the same agony, not even my worst enemy. I really feel for the people still stuck in the mess.
I talked to a Polish guy who had been here 9 years fully legally and could not leave. He had not seen his family in 9 years and did not want to risk going back just in case they would not approve his H1B in his home country. They are very strict there it seems, because none of his family members or friends could not even get a tourist nor visit visa to see his graduation. Shocking!
I was glad I showed up at the rally just to hear all the peoples' stories.
Most people who did not show up probably think they are ok after applying the i485. They will join IV rallies, when they realize how wrong they are. People have applied for i485s years ago and still don't have a green card...

There was another russian gentleman who got his green card 6 months back and is a student now. Yet, he had driven 3 hours from NJ just to cheer us. He mentioned that he understands how painful this process is and wanted to encourage us by attending.
I met an Indian who got his green card in year2003. Still he attended to give moral support to IV. Hats off to all those guys who made it to the rally even after getting there GC's. Hopefully those people who are still stuck in the GC mess realize the importance to actively participate in the events organized by IV.

1. I don't like the attitude that comes along with the people that speak it.
2. I just don't like the language.
3. I don't live anywhere close to a place where I must know Hindi to survive.
4. The Indian Constitution recognises English as a subsidiary official language.
5. If I have survived as long as I have without knowing Hindi, I'm sure I can survive without knowing Hindi for the rest of my life.

Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything
The DOS algorithm to allocate unalloted Visas in the last quarter has so far been inconsistent. In previous years it favored EB3 and now it is totally skewed in favour of EB2 . From the deposition of the DOS @ congress they think that this year's algorithm will be the model for years to come.
Now , obviously that is great for EB2 because EB2 will get the lion share/complete share of the spillover . But death knell for EB3.
EB3 will not get anymore ~3000 visas every year till EB2 becomes current.
This will starve EB3 badly , EB2 will be current most of the time and EB3 will in 2001-02 time frame. There is a possibility that 2008 EB2 filers might GC ahead of 2003 EB3 filers.
Starving any particular queue badly does not help the throughput of any system .
I hope DOS will realise this and change their algorithm accordingly.
Each countries quota is equally divided among all EB categories, IMO, The spill overs also should be equally divided among all the EB categories.
